California Proposition 65 Statements

All products shipped by BuyUSPromos.com into the State of California are subject to Proposition 65 regulations. Proposition 65 is also known as The Safe Drinking Water and Toxic Enforcement Act of 1986. Proposition 65 was originally enacted to protect California citizens and the State’s drinking water supply from various chemicals determined by a state agency to cause birth defects, cancer or other diseases or harm. Over 850 chemicals are now included on California’s list of Proposition 65 chemicals. A complete list of chemicals can be found at www.oehha.ca.gov/prop65.

Proposition 65 requires any person or company to give a “clear and reasonable warning” to any individuals before “knowingly and intentionally” exposing them to any of the listed Proposition 65 chemicals during the course of doing business. The regulation includes activities that involve manufacturing, assembling, distributing, storing, selling or any other activity that involves the transfer of consumer products.

This warning must occur unless the person or company can demonstrate that the exposure to the chemical is so small that it causes “no significant risk” or “no observable effect.” For most of the Proposition 65 chemicals, the Office of Environmental Health Hazard Assessment has determined “safe harbor” levels of exposure. As long as the chemical level falls below the “safe harbor” level, no warning is required.

BuyUSPromos.com is committed to providing high quality, safe products for our customers. We have always and will continue to work with our vendors and suppliers to ensure all raw materials purchased from them will meet Proposition 65 standards. In addition to Proposition 65 compliance, BuyUSPromos.com has also instituted testing and documentation procedures to help ensure that all of our products comply with all federal and state requirements.

Companies are becoming increasingly vulnerable to lawsuits relating to Proposition 65. Any section of Proposition 65 may be enforced by the California Attorney General, local district attorneys, and private plaintiffs filing suits in the public interest. Proposition 65 does not just cover items manufactured in California. It covers all products entering California. Businesses located outside the state that ship products to California fall under the regulation.

BuyUSPromos.com’ s efforts have primarily focused on the third party testing for signs of lead content in our products. Lead has traditionally been the primary concern for our customers and the main focus of Proposition 65 litigation. Our third party testing is designed to confirm that the product’s lining and exterior meet “safe harbor” requirements for lead content that have been accepted by Proposition 65 and California courts.

BuyUSPromos.com cannot test every piece of product it ships into California and has not tested its products for every one of the over 850 Proposition 65 chemicals in addition to lead. Because of this, our customers may have some concern regarding Proposition 65 compliance. One option to ensure compliance is to include a label on all products that may ship to the State of California. The label would state the following:

WARNING: This product contains chemicals known to the State of California to cause cancer, birth defects or other reproductive harm.

Please contact us for more information on Proposition 65 and BuyUSPromos.com’ s compliance program.

Statement of Lead Content in Inks

BuyUSPromos.com is committed to providing high quality, safe products for our customers. BuyUSPromos.com is continually working with our vendors to ensure all materials used in the production of our products meet all federal and state health and safety standards, including California Proposition 65.

BuyUSPromos.com purchases inks and other supplies from a number of suppliers throughout the United States. Our ink suppliers have conducted extensive testing to document the lead content for all ink systems we currently use to decorate our products. The lead content of all the inks BuyUSPromos.com uses meet all current local and federal regulations. Testing data is available upon request.

CPSIA Compliance

BuyUSPromos.com has developed a comprehensive program to ensure products manufactured for our company comply with the Consumer Product Safety Improvement Act (CPSIA) of 2008. BuyUSPromos.com CPSIA program includes testing for all CPSC-regulated standards applicable to our products, including lead content and lead in substrates, products containing certain phthalates and lead in paint and surface coatings.

Certain sections of the law do pertain to the Promotional Products Industry, specifically to those items classified as Children’s Products. All the items found in our online catalog are designed to meet applicable Federal and State regulations. However, these items are not designed for, or intended for use by children (unless marked otherwise). Despite this, BuyUSPromos.com has undertaken testing campaigns to ensure that certain products that may appeal to children meet CPSIA requirements.

BuyUSPromos.com utilizes accredited third party testing labs. These testing labs issue certificates to substantiate that the tested products meet all     applicable CPSIA requirements.  BuyUSPromos.com also maintains General Certificate of Compliance (GCC) forms for all products in our line that may appeal to children as well as products requiring general certification. These forms are available upon request.

Depending on what is reasonably practical, BuyUSPromos.com satisfies the tracking label requirement by providing compliant tracking information on either individual item labeling or more commonly on packaging.

Though some CPSIA issues remain open and fluid, BuyUSPromos.com wants to assure our customers that we are vigorously pursuing compliance with not only CPSIA, but all federal and local regulations and that we have a comprehensive testing and documentation program in place.

Yes–Buy USA Means You too!

bu usa-made productsI was at a trade show a few weeks back and stopped at various booths from American manufacturers and one branch of the military– and they noticed they were all handing out promotional items that were Made in China.

That’s right.

These organizations were spending thousands of dollars exhibiting at this particular trade show to promote a “Buy American” theme– and they didn’t even have the forethought to buy American-made promotional items.

Where is that logic?

Where is the consistency of messaging?

How can you expect others to Buy American when you don’t even believe in the cause?

Vet your suppliers to make sure that they are using American factories — for everything!

Buy and drive American-made cars.

Give away American-made promotional items. There are tens of thousands of unique promotional items that are made in the USA–as you can see from our link.

Be sure your clothing and/or uniforms are made int he USA.

Be a representative of all that is good about American-made products.

Be a “Made in the USA” ambassador.

Do not take the easy way out and just talk the talk.

After all, do you want your customers doing the same to you?

Consistently buy Made in America.

Promote America.

Keep jobs in America!

Remember, the American job you save may be your own.

Are You Exclusively Looking to Buy American-Made Products?

How Consistent Are You in Buying American-Made Products?

Are you consistently buying American Made Products?Austin, Texas: I had dinner the other night with an executive of a large American factory — and he picked me up in his black 2012Mercedes-Benz Cabriolet E350 RWD.

Beautiful car. Wrong message.

How can this person expect his customers to support American jobs when he is buying a car that is not Made in America!??!

Are you being consistent in your purchases – and continuously seeking for an American-made alternative?

If not, why not?

If you are promoting an “American-Made culture” then you need to live it.

Breathe it.

Immerse yourself in it.

You car should be American-Made.

Your watch, your clothing, etc. should be American-made.

Re-train yourself (and your employees and family) to look for American-made products first and foremost.

Change your buying patterns and behaviors.

If you sell American-made products–you need to be buying American-made products.

Not from time to time.

But all the time.

Remember, the American job you save may be your own.

Made in the USA: Water Bottles Can Beat Import Prices

February 28th, 2013 No comments

promotional water bottles made in the USAAustin, Texas: We get calls on a daily basis asking us about water bottles–and most people think that it is cheaper to go overseas.

However, on plastic bottles, they are usually mistaken– as these can be produced in America for less than import prices – and the savings in time and shipping costs cannot be beat.

These American made plastic water bottles can be produced and shipped in a matter of a few short days–helping to avoid logistical problems and saving freight costs.

Take these five plastic 27-oz promotional water bottles. Not only are they made in the United States– they are also made in a Union Shop.

On top of that, they are QCA-rated, meaning that pass the highest ratings for quality assurance, something that anyone giving away something that is put into the body is concerned about.

So, next time someone tells you to look for imported promotional items, think again.

If it is plastic, we can probably beat that price by a long shot–and keep jobs right here in America.

Remember, the American job you save may be your own.

Increasing Support for Union Jobs Might Take a PR Effort

January 7th, 2013 No comments

Increase Union Jobs Through Awareness, Not Legislation Battles

A new PR campaign might be needed for greater support for Union jobs.

Austin, Texas: There has been a great deal of press over the past few months about Union jobs and the increase in right to work legislation in some states.

Although our company, BuyUSPromos.com tries to promote American jobs whether they are unionized or not, we have been paying special attention lately to adding more Union-shop factories to our list of vendors.

After meeting and dealing with these hard working factories, our New Year’s resolution was to increase by 20% the number of Union shops that we work with in 2013 — in making our tote bags, imprinted bandannas, water bottles and mugs and other promotional products.

I have been turned off by the way the media has been portraying the Unions and its members and feel that it is time to support these Unions — before they do not exist any longer.

I also think that it is time for the Unions to fight back in the media —  in public relations — on the air, in social media – wherever — to explain the value that Unions offer the country.

Perhaps if Americans hear from Union workers (not necessarily strident Union leaders), then a softer and more honest image can be created and the role and value of Union workers can be re-established.

Fighting for higher pay regardless of the profitability of factories is a losing argument.

Fighting for greater respect, better working conditions and a fair wage is certainly something that most Americans can stand for.

Support Union jobs

Remember, the American job you save may be your own.

Political Campaigns Should Only Use Made in the USA Signs and Bumper Stickers

June 1st, 2012 No comments

Campaign promotional items made in the USAAustin, Texas: It is only June and we are in the middle of election fever and political campaigning.

We have already done so many orders for candidates on all sides of the political spectrum – and now it is runoff time.  Then the general election in November.

Great for our business of promotional products made in the USA.

Great for the networks.

Great for the economy.

However, I am still concerned at the number of campaigns that are not buying their election yard signs, bumper stickers, pins and other promotional items from American-made factories.

There are a ton of imprinted bumper stickers, hand fans, campaign buttons and political yard signs that are made in the USA – that cost about the same as imports.

It seems like a no-brainer.

After all, which candidate wants to be the one that doesn’t want to promote American prosperity and American jobs?

Remember, the job you save may be your own!

Occupy Christmas: Buy American

December 21st, 2011 No comments

Buy American movement-Occupy Christmas

New Organization Tries To Encourage Consumers to Buy US-Made Gifts

CNN did a recent report on an organization called Occupy Christmas, with its stated goal to encourage more people to buy American-made gifts this Holiday season.

According to the article, this group is trying to “help boost the domestic economy and reverse the tide of rising unemployment, for some, it means buying American. Others patronize mom-and-pop shops or crafts fairs or buy gift cards for local restaurants or services.”

According to CNN, the “Buy American” movement has been gaining momentum in recent years amid the economic downturn, steady unemployment and pledges from the Obama administration to reinvigorate the manufacturing sector.

A 2010 Adweek Media/Harris Poll found that 61% of Americans said they were more likely to purchase a product advertised as “Made in America.” In an ABC News special devoted to the topic, Diane Sawyer challenged Americans to spend $64 on American-made goods during holiday shopping, claiming that it would create 200,000 new jobs.

“A lot of consumers believe it’s a way to assist in all the issues we’re dealing with,” said University of Wisconsin consumer science professor Cynthia Jasper. “They believe that the money spent is reinvested in the local community in terms of taxes and jobs. Many consumers, because of the economic climate, want to to support their local communities.”

As Americans, we can control our destinies.  Let’s all make a concerted effort to switch 20% of our purchases to US-made products.

It will have a tremendous positive effect on this country in terms of increased employment opportunities, more tax revenue for our counties, cities, states and federal government, and an opportunity to reduce the growing deficit problem.

20% is a small goal that should be easily attainable if we take the time to shop around – and it can have far-reaching benefits.

Remember, the job you save may be your own!

November 23rd, 2011 No comments

Welcome to our new blog, BuyUSBlog, which is dedicated to the American spirit.

We are tired of seeing American jobs sent overseas and US factory production shuttered while unemployment in this country hovers at around 9%–with no improvement in sight.

This blog will encourage Americans to first look domestically for products, supplies, raw goods, etc.

Support your community.

Keep America strong by creating jobs and supporting American-made products.

America first.
